James Tunley

James joined Chambers in November 2007, following successful completion of pupillage at Old Square Chambers.

James undertakes a full range of civil work including employment law, personal injury, road traffic claims, contractual disputes, and property litigation.

He appears for both claimants and respondents in the Employment Tribunal at all stages of proceedings in all areas of employment law including unfair dismissal, discrimination, victimisation, TUPE, breach of contract, and wages claims. He is also instructed to advise on contentious and non-contentious employment law issues.

James has a general personal injury practice. He has acted on behalf of claimants and defendants in fast track and small claims trials and has also appeared before the Criminal Injuries Compensation Appeal Panel. He is happy to advise or draft pleadings in personal injury claims. James also undertakes interlocutory hearings such as case management conferences and applications, including strike out and summary judgment.

In addition to civil work, James undertakes a full range of criminal defence work and regularly appears in the Magistrates’ and Youth Courts. He also prosecutes on behalf of Serco.

Recent Cases

Hamid Elkiyari and ISS Mediclean. Mr Elkiyari had been dismissed from his job as a chef at Kingston Hospital. Iss Mediclean dismissed Mr Elkiyari, who had worked at the hospital for 23 years, for eating a piece of garlic bread. London South Employment Tribunal upheld the claims of unfair dismissal and race discrimination.
